By April 1st 2023, landlords will no longer be able to continue leasing non-domestic properties if they have an Energy Performance Certificate rating of F or G (the least energy-efficient properties). This change will apply to non-domestic premises that have existing leases.

There will be fines for non-compliance, fines currently range from £5,000 up to 10% of the rateable value of the property (whichever is more). Offenders who do not comply within a set time could be fined up to £150,000.

Following properties with a rating of F or G, compliance with the new standard in the MEES Regulations will be required in new and existing leases;

  • Rating D by 2025
  • Rating C by 2027
  • Rating B by 2030
